What Is a Special Needs Trust?

A Special Needs Trust (SNT) is a trust designed to benefit a disabled person who is the recipient of public benefits such as Supplemental Security Income (SSI) and Medi-Cal.  The SNT is drafted and administered to supplement the disabled beneficiary’s needs above and beyond what the public benefits provide to the beneficiary without disqualifying the beneficiary from receiving those needs-based public benefits.

Who can create a Special Needs Trust?

  • A third party to the disabled beneficiary (called a Third Party SNT)
  • The disabled person (called a First Party SNT)
